1. Who we are

2. Using our websites

You agree to use the sites lawfully and not to interfere with their security or operation, copy their content, or use automated tools to buy products in bulk. We try to keep the sites accurate and available, but we can't guarantee they'll be free of errors or interruptions.

3. Products

We describe and photograph products as accurately as we can. Colours may look slightly different on screen, and sizes may vary slightly between garment styles and batches. Please check the size guide before ordering. Stock is limited, especially for tour and Fan Club items, and we may limit the quantity per customer.

4. Prices and payment

• All prices are in South African rand (ZAR) and [include VAT / are VAT-exclusive: confirm VAT registration status].
• Delivery fees are shown at checkout before you pay.
• Payment is processed securely by YOCO. We do not see or store your full card details.
• If a product is listed at an obviously incorrect price, we'll contact you before processing the order. You can then pay the correct price or cancel for a full refund.

5. When a contract is formed

Your order is an offer to buy. The contract is formed when we send you an order confirmation email. We may decline an order, for example if an item is out of stock or we suspect fraud. If we decline after you've paid, we'll refund you in full.

6. Pre-orders

• Pre-order items are paid for in full when you order.
• Each listing shows an estimated dispatch or pickup date. This is an estimate, not a guarantee.
• If a pre-order will be more than [14] days late, we'll tell you and you may cancel for a full refund.
• If we can't fulfil a pre-order at all, we'll refund you in full.

7. Event pickup

• Where offered, you can choose to collect your order at a specific event, such as a concert venue. The pickup location, date and collection point are shown at checkout and in your confirmation email.
• To collect, show your order confirmation (on your phone is fine) and a valid ID in the name on the order.
• Someone else can collect for you if you email us their name beforehand. They must show your order confirmation and their own ID.
• Orders can only be collected at the event you selected. If you can't make it, contact us within [7] days after the event. We can arrange delivery at your cost, or collection from our Stellenbosch address.
• If we don't hear from you within [30] days after the event, we may cancel the order and refund the purchase price, less any costs we reasonably incurred.

8. Delivery

• Event merchandise is collected at the Merchhaus store or pop-up stand at the event — we do not currently ship via courier. If you ask us to arrange delivery, we'll confirm the cost with you first, and delivery times are estimates.
• Ownership and risk pass to you on delivery or collection.
• Please check your order when it arrives, and report missing or damaged items within [48 hours].

9. Custom and branded orders (corporate clients)

• Quotes are valid for [14] days unless stated otherwise.
• Deposit: production starts once we've received a [50]% deposit and your written approval of the final artwork proof. The balance is due before dispatch.
• Artwork approval: check every proof carefully for spelling, colours, size and placement. Once approved, we're not responsible for errors in the approved artwork.
• Your artwork: you confirm you own or have permission to use any logos, names or designs you send us, and you indemnify Merchhaus against claims arising from their use.
• Colour matching: we match Pantone references as closely as possible, but colours can vary between fabrics and print methods. An exact match can't be guaranteed.
• Quantities: branded production runs may vary by up to [2]% from the ordered quantity. We'll credit or invoice the difference.
• Lead times run from artwork approval and receipt of deposit, whichever is later.

10. Fan Club

Fan Club membership is personal and can't be transferred. Members-only products are for personal use, not resale. We may change Fan Club benefits, or suspend access for misuse, at any time.

11. Intellectual property

All content on the sites, including the Merchhaus name, logo, text and images, belongs to Merchhaus or its licensors. Artist merchandise designs belong to the relevant artists or rights holders. You may not copy or use any of it without written permission.

12. Cancellations, returns and refunds

Your right to cancel an online order within 7 days (the ECTA cooling-off period), and your rights for defective goods, are set out in our Returns, Refunds & Cancellations Policy.

13. Liability

To the extent the law allows, Merchhaus is not liable for indirect or consequential loss arising from the use of our sites or products. Our total liability for any order is limited to the amount you paid for it. This does not limit liability we can't exclude by law, including under the CPA.

14. Privacy

We handle your personal information in line with our Privacy Policy and POPIA.

15. Disputes and governing law

These terms are governed by South African law. If something goes wrong, please contact us first so we can try to fix it. If we can't resolve it, you may approach the Consumer Goods and Services Ombud or the National Consumer Commission, or the courts of South Africa.

16. Changes to these terms

We may update these terms from time to time. The version on this page when you place an order applies to that order.
